These terms and conditions outline the rules and regulations for the use of WRITERESQUE's Website, located at www.writeresque.com

By accessing this website we assume you accept these terms and conditions. Do not continue to use WRITERESQUE if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Rights

We retain the unrestricted right to publish selected stories in WRITERESQUE Literary Magazine in print and online, and in any relevant promotional material, and will retain copyright and economic rights for the anthology as a whole.

All rights for individual stories, poems, prose, revert back to their respective author upon publication.

The author is free to republish their work, either in part, as a whole, or in an altered form, wherever and whenever they like.

For photography: 

 

The photographer owns all the rights, including copyright, necessary to submit this Photograph to Writeresque Magazine. Once an image is accepted to be published, it grants us the permission to use your work in any of our future publications, websites, marketing pieces, advertisements, and any other mediums or formats used in the creation, dissemination, and monetization of Writeresque Magazine.  

 

By submitting any photography to us, you consent to indemnify Writeresque Magazine against any claim, demand, action, suit, or other proceedings against Writeresque's arising out of the use of the photograph and related to any false or inaccurate statement.  

 

You grant this authorization free of charge and understand and agree that Writeresque Magazine does not currently provide complimentary copies of our print-on-demand publication or pay for your shoots. However, we will promote your work on social media, events, and promotions.  

 

Once images are approved for publication, you give us the right to correct/edit/retouch pictures if needed.   Participants who have modelled or posed in the photo have assigned all relevant rights to the photographer, and signed the model release. Pictures with models, without the release won't be accepted.  

 

You understand that submission does not mean acceptance, and that all submissions are subjected to review.

Accreditation 

Any literary work first published by us must credit WRITERESQUE as the original publisher should it be republished elsewhere, and vice versa. When submitting literary work to us that has previously been published elsewhere, it is the AUTHOR'S responsibility to credit the original publisher. Writeresque Literary Magazine shall not be held responsible should no original publisher be credited by the author.

Payments, Donations & Subscriptions

Writeresque has a no-refund policy for one-time submissions and donations. No refunds can be offered for Subscription payments already made, but users can cancel the subscription. Upon cancelation, users can still access services until the end of the payment period.

License

Unless otherwise stated, WRITERESQUE and/or its licensors/writers own the intellectual property rights for all material on WRITERESQUE. All intellectual property rights are reserved. You may access this from WRITERESQUE for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material from WRITERESQUE*

• Submit any intellectual property or in other word, you are strictly forbidden from plagiarism**  

• Sell, rent or sub-license material from WRITERESQUE

• Reproduce, duplicate or copy material from WRITERESQUE

• Redistribute content from WRITERESQUE

This Agreement shall begin on the date hereof.

*this does not apply to the authors featured in any form of WRITERESQUE who are allowed to republish their work;

**In the case of proven plagiarism, the submitter will immediately be banned from using WRITERESQUE and their account and submission/s will be deleted.

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. WRITERESQUE may (but does not always) filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of WRITERESQUE, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, WRITERESQUE shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

WRITERESQUE reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

• You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;

You hereby grant WRITERESQUE a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.

When submitting to us, you give us your consent to publish your name, the name of your work, your biography and picture on our website as well as in print and across our social media channels to promote both yourself and our magazine.

 

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

• Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
